Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the products and services provided by Aeronautic AI Systems ABN 60 697 274 436 (“we”, “us”, “our”), including AeroReport, 9er.ai, and AirCrash Report (collectively, the “Services”).
By creating an account or using any of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Description of Services
The Services provide AI-assisted access to aviation regulatory documents, accident investigation reports, and related intelligence. They are designed as research and reference tools for aviation professionals, researchers, and enthusiasts.
The Services are not certified aviation safety systems. Nothing in the Services constitutes airworthiness advice, operational approval, regulatory sign-off, or a substitute for qualified aviation professional judgement. Do not use the Services as the sole basis for any safety-critical aviation decision. The Services support, but do not replace, your own compliance obligations. You remain responsible for verifying any regulatory requirement against the source instrument before acting on it.
2. Accounts
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it.
You must be at least 15 years of age to create an account. By registering, you represent that you meet this requirement.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
3. Free Tier and Subscriptions
Free tier. We offer a free tier providing a limited number of queries per month at no cost and without payment details. The current allowance is shown on the pricing page. Free tier quotas reset monthly and may change at our discretion. We may limit or suspend free tier access where we reasonably believe it is being used to circumvent quotas, including through the creation of multiple accounts.
Paid subscriptions. Paid plans are available on a monthly or annual basis. Fees are charged in advance through Stripe. Prices are shown and charged in your local currency where we support it, and in Australian dollars (AUD) otherwise. Where you are charged in AUD and your payment method is denominated in another currency, your card issuer or bank determines the exchange rate applied and may charge a foreign transaction fee. Prices in each currency are set by us and do not vary with exchange rates. All prices are inclusive of any Australian GST that may apply. We are not currently registered for GST. If we become registered, the published price remains the price you pay.
Seats. Team plans are charged per seat with a minimum of three seats. Where you add seats during a billing period, the additional seats are charged pro rata to the end of that period.
Automatic renewal. Subscriptions renew automatically at the end of each billing period — monthly plans each month, annual plans each year — at the then-current price for your plan, unless you cancel beforehand. We will email you before an annual subscription renews.
Cancellation. You may cancel at any time through the member portal. Cancellation takes effect at the end of the current billing period and you retain access until then.
Refunds. Except as required by law, we do not refund partial billing periods on monthly subscriptions. For annual subscriptions, you may request a full refund within 30 days of purchase. After 30 days, we may at our discretion refund the unused portion of an annual term. If you believe you have been charged in error, contact us at help@aeronautic.co.
Nothing in this clause limits your rights under the Australian Consumer Law, including your right to a remedy where the Services are not supplied with due care and skill or are not reasonably fit for a disclosed purpose.
Price changes. We will give at least 30 days’ notice of any price increase, which takes effect at your next renewal.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law
- Attempt to circumvent usage quotas, authentication, or access controls
- Use automated means to scrape, harvest, or bulk-query the Services without our written consent
- Resell or sublicense access to the Services without our written consent
- Interfere with or disrupt the integrity or performance of the Services
- Use the Services to train, fine-tune, or develop competing AI models
- Misrepresent AI-generated output as certified regulatory or safety advice
- Create multiple accounts in order to obtain additional free tier quota
5. Intellectual Property
The Services, including their software, design, and underlying systems, are owned by Aeronautic AI Systems and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Services for your own internal purposes in accordance with these Terms.
Regulatory documents, accident reports, and other third-party materials surfaced by the Services remain the property of their respective owners and are subject to their own terms of use. We do not claim ownership of such materials.
You retain ownership of any data you submit to the Services. By submitting content, you grant us a limited licence to process it for the purpose of providing the Services.
6. Disclaimers
Except as required by law, including the Australian Consumer Law:
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or that any particular query will return accurate, complete, or current results. Aviation regulations change frequently; always verify information against the authoritative source before relying on it.
AI-generated responses may contain errors, hallucinations, or outdated information. You are solely responsible for verifying the accuracy of any information obtained through the Services.
Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
7. Limitation of Liability
To the maximum extent permitted by law, Aeronautic AI Systems and its personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the Services shall not exceed the amount you paid us in the three months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms excludes liability that cannot be excluded by law, including under the Australian Consumer Law.
8. Termination
You may stop using the Services and close your account at any time by contacting us at help@aeronautic.co.
We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if we discontinue the Services. Where reasonably practicable, we will give you advance notice.
On termination, your right to use the Services ceases. Sections 5, 6, 7, and 9 survive termination.
9. Governing Law
These Terms are governed by the laws of Western Australia, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Western Australia for any dispute arising under these Terms. Nothing in this clause limits your rights under mandatory consumer protection laws in your jurisdiction.
10. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms at this URL with an updated date. For material changes, we will notify you by email where we hold your address. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
